The Mayor called the meeting to order at 7:30 p.m.

Mayor Barrow transferred the Chair to Regional and Local Councillor DiPaola for consideration of the motion moved by Councillor West related to Item 13.4.

Council consented to recess the meeting between 9:19 p.m. and 9:27 p.m.

Gwen Ferraro, 159 Collin Court, to request that By-law 84-03 regarding front yard parking and landscaping be amended and to present a petition with approximately 27 signatures from area residents in support of her request.

Liz Couture, 7-75 Norman Bethune Avenue, and Esther Collier, 411 Palliser Crescent North, regarding climate change and the reduction of greenhouse gas emissions. They advised of the launch of Global Warming Drawdown Richmond Hill Group and their interest in working with the Town to address local climate change issues.

Councillor Chan advised that on December 16th he provided members of the 778 Banshee Squadron with an overview of municipal government, including the services provided and role of a municipal Councillor.

Councillor Muench extended congratulations to each member of the 2018 to 2022 Town of Richmond Hill Council, and wished everyone a Merry Christmas and happy holidays.

Karen Mortfield, on behalf of her mother Brenda Schnier, 45 Baif Boulevard, addressed Council regarding the proposed amendments to the Taxi By-law 133-04 and Municipal Code Chapter 882. She advised that her parents purchased a Richmond Hill taxi license as an investment and noted the impact that private taxi companies such as Uber has had on the industry. Ms. Mortfield advised that they were in agreement with the proposed amendments to the taxi by-law and requested that Council direct staff to examine appropriate measures to regulate private transportation companies.

Cathy Platanitis, on behalf of Peter Madronis, Peter’s Taxi Ltd., addressed Council regarding the proposed amendments to the Taxi By-law 133-04 and Municipal Code Chapter 882. She advised that they were in agreement with the comments made by the previous speaker, provided additional information related to the impact of private transportation companies on the industry, and issues with the current regulatory framework. Ms. Platanitis acknowledged the efforts being made to assist the taxi industry and requested that the private companies also be regulated.

Marcia Papa, 83 Alpaca Drive, addressed Council regarding the Report from ADR Chambers Inc., Integrity Commissioner Office for the Town of Richmond Hill, regarding a complaint under the Town’s Council Code of Conduct. She addressed the information contained in the Report, effects of bullying and harassment, and the impact the events and actions have had on the victims. Ms. Papa requested that Council take the matter seriously when determining a reprimand under the Council Code of Conduct.

Katie McMahon, 725-3 Ellesmere Street, addressed Council regarding the Report from ADR Chambers Inc., Integrity Commissioner Office for the Town of Richmond Hill, regarding a complaint under the Town’s Council Code of Conduct. She addressed the information contained in the Report and reviewed events and email communications related to the music community and use of the “Ward 5” moniker. Ms. McMahon requested a strong reprimand be imposed under the Council Code of Conduct so that the matter could be resolved.

Matthew Bergman, 302 Thornhill Woods Drive, Thornhill, addressed Council regarding the Report from ADR Chambers Inc., Integrity Commissioner Office for the Town of Richmond Hill, regarding a complaint under the Town’s Council Code of Conduct. He addressed the information contained in the Report, reviewed events that led to the complaint being filed with the current Integrity Commissioner Office, and the impact the events and actions have had on him and others. Mr. Bergman requested that the maximum punishment be imposed under the Council Code of Conduct and stressed the importance of holding public officials accountable for their actions.

Gregory Swain, 116 Lucas Street, addressed Council regarding the Report from ADR Chambers Inc., Integrity Commissioner Office for the Town of Richmond Hill, regarding a complaint under the Town’s Council Code of Conduct. He addressed the information contained in the Report, reviewed events related to the music community that led to the complaint being filed with the current Integrity Commissioner Office, and the impact the events and actions have had on those involved.

David Grossman, 194 Pleasant Ridge Avenue, Vaughan, addressed Council regarding the Report from ADR Chambers Inc., Integrity Commissioner Office for the Town of Richmond Hill, regarding a complaint under the Town's Council Code of Conduct. He addressed the information contained in the Report, reviewed events that led to the complaint being filed with the current Integrity Commissioner Office, expressed concern that the matter was not addressed when first brought forward, and detailed the impact the events actions have had on those involved. Mr. Grossman requested that the funding, organization and promotion of future music related events be overseen by the Mayor.

Steffi Goodfield, 29 Ruby Crescent, , addressed Council regarding the Report from ADR Chambers Inc., Integrity Commissioner Office for the Town of Richmond Hill, regarding a complaint under the Town's Council Code of Conduct. She addressed the information contained in the Report, reviewed events that led to the complaint being filed with the current Integrity Commissioner Office, and detailed the impact the events and actions have had on her and those involved, and on the Richmond Hill music community.

Michael Dankevy, 93 Houseman Crescent, addressed Council regarding the Report from ADR Chambers Inc., Integrity Commissioner Office for the Town of Richmond Hill, regarding a complaint under the Town’s Council Code of Conduct. He addressed the information contained in the Report, detailed the impact the events and actions have had on those involved, and acknowledged the efforts of the local music community. Mr. Dankevy requested that Council take appropriate action to address the matter.

Cindy VanBrussel, 4321 Queen Street, Niagara Falls, addressed Council regarding the Report from ADR Chambers Inc., Integrity Commissioner Office for the Town of Richmond Hill. She read a statement on behalf of Jeff Offman, resident of Thornhill, related to the impact the events and actions detailed in the Report had on those involved. Ms. VanBrussel requested that Council impose the maximum reprimand under the Council Code of Conduct.

That the minutes of the Committee of the Whole meeting CW#14-18 held December 11, 2018 be adopted as circulated and the following recommendations approved:

    b) That taxes amounting to $58,215.87 be written off pursuant to the provisions of Section 357 of the Municipal Act, 2001;

    c) That taxes amounting to $2,547.40 be written off pursuant to the provisions of Section 358 of the Municipal Act, 2001;

    d) That applicable penalty and interest be adjusted accordingly;

    e) That the Treasurer be directed to adjust the accounts receivable accordingly.

    c) That Richmond Hill opt-out of cannabis retail stores within its municipal boundaries in accordance with the Cannabis Law Statute Amendment Act, 2018, which allows municipalities to do so before January 22, 2019;

    d) That the Clerk provide notice of this decision of Richmond Hill Council to the Alcohol and Gaming Commission of Ontario (AGCO) Registrar as required by the Act.

    Whereas the Federation of Canadian Municipalities (FCM) represents the interests of municipalities on policy and program matters that fall within federal jurisdiction;

    Whereas FCM’s Board of Directors is comprised of elected municipal officials from all regions and sizes of communities to form a broad base of support and provide FCM with the prestige required to carry the municipal message to the federal government; and

    Whereas FCM’s Annual Conference and Trade Show will take place each June, during which time the Annual General Meeting will be held and followed by the election of FCM’s Board of Directors;

    Now therefore the Council of Richmond Hill resolves the following:

    That Council of the Town of Richmond Hill endorse Councillor Godwin Chan to stand for election on FCM’s Board of Directors for the duration of the term; and

    That Council assumes all costs associated with Councillor Godwin Chan, if elected or appointed, attending FCM’s Board of Directors and Committee meetings.

    Whereas Sections 4.2 of the Procedure By-law 74-12 requires Council to appoint a Deputy Mayor, and Section 4.3 authorizes Council to appoint an Acting Mayor;

    Whereas Richmond Hill’s Regional and Local Councillors have been appointed Deputy Mayor or Acting Mayor;

    Whereas both the Deputy Mayor and Acting Mayor are permitted to act in place of the Mayor fulfilling the same duties and responsibilities;

    Now therefore the Council of the Town of Richmond Hill resolves the following:

    That the Procedure By-law 74-12, as amended, be further amended as follows:

    1. That the definition of “Acting Mayor” be deleted in its entirety;
    2. That the definition of “Deputy Mayor” be deleted and replaced with the following:

    “Deputy Mayor” means the Member(s) appointed to act in place of the Mayor pursuant to section 4.2 of these Rules of Procedure.

    1. That section 4.2, titled “Deputy Mayor,” be deleted and replaced with the following:

    “4.2     Deputy Mayor

    (a) Council shall by by-law appoint not more than two Members, both of whom shall normally be a Regional and Local Councillor, to act as Deputy Mayor for a duration at the discretion of Council.

    (b) If Council has appointed only one Deputy Mayor, in the absence or inability of the Mayor to act, such Deputy Mayor shall exercise all the Mayor’s rights and duties as set out in this by-law or Applicable Law.

    (c)  If Council has appointed more than one Deputy Mayor, in the absence or inability of the Mayor to act:

    (i)    during the months of January to June, the Deputy Mayor whose name is listed first on the appointment by-law shall exercise all the Mayor’s rights and duties as set out in this by-law or Applicable Law;

    (ii)   during the months of July to December, the Deputy Mayor whose name is listed second on the appointment by-law shall exercise all the Mayor’s rights and duties as set out in this by-law or Applicable Law; or

    (iii) if the Deputy Mayor who would normally act in the place of the Mayor pursuant to either sections 4.2(c)(i) or 4.2(c)(ii) is absent or unable to Act, the other appointed Deputy Mayor shall exercise all the Mayor’s rights and duties as set out in this by-law or Applicable Law.”

    1. That section 4.3, titled “Acting Mayor,” be deleted in its entirety.
    2. That subsection 5.2.4, titled “Mayor Absent – Council” be deleted and replaced with the following:

    “5.2.4     Mayor Absent – One Appointed Deputy Mayor

    Unless the Mayor is scheduled to be absent for a Meeting, in the case of the Mayor not attending within fifteen (15) minutes after the scheduled start time of the Meeting of Council for which there is Quorum, if only one Member has been appointed as Deputy Mayor then, provided the Deputy Mayor is not scheduled to be absent;

    (a)   the Deputy Mayor shall take the Chair, call the Members to order and preside until the Mayor arrives; or

    (b)   If the Deputy Mayor also does not attend within fifteen (15) minutes after the scheduled start time of the Meeting of Council along with the Mayor, then the Clerk shall call the Members to order and a Chair shall be chosen from among the Members present, who will preside over the Meeting until the arrival of the Mayor or Deputy Mayor.”

    1. That subsection 5.2.5, titled “Mayor and Deputy Mayor Absent” be deleted and replaced with the following:

    “5.2.5     Mayor Absent – Two Appointed Deputy Mayors

    Unless the Mayor is scheduled to be absent for a Meeting, in the case of the Mayor not attending within fifteen (15) minutes after the scheduled start time of the Meeting of Council for which there is Quorum, if two Members have been appointed as Deputy Mayors then, provided that neither Deputy Mayor is scheduled to be absent;

    (a)   During a meeting held in the months of January to June, the Deputy Mayor whose name is listed first on the appointment by-law is present, that Deputy Mayor shall take the Chair, call the Members to order and preside until the Mayor arrives;

    (b)   During a meeting held in the months of July to December, the Deputy Mayor whose name is listed second on the appointment by-law is present, that Deputy Mayor shall take the Chair, call the Members to order and preside until the Mayor arrives;

    (c)    if the Deputy Mayor who would normally preside pursuant to Sections 5.2.5(a) or 5.2.5(b) does not attend within fifteen (15) minutes after the scheduled start time of the Meeting of Council the other Deputy Mayor shall take the Chair, call the Members to order and preside until the Mayor arrives

    (d) If both Deputy Mayor’s do not attend within fifteen (15) minutes after the scheduled start time of the Meeting of Council along with the Mayor, then the Clerk shall call the Members to order and a Chair shall be chosen from among the Members present, who will preside over the Meeting until the arrival of the Mayor or a Deputy Mayor.”

    7. That section 5.2.6, titled “Mayor, Deputy Mayor and Acting Mayor Absent,” be deleted in its entirety

Maynard, ADR Chambers Inc., Integrity Commissioner Office for the Town of Richmond Hill, dated November 13, 2018, regarding a complaint under the Town's Council Code of Conduct, be received;

    b) That Councillor Karen Cilevitz be and is hereby reprimanded for violating the Council Code of Conduct.

    Whereas the relevant part of Section 7 of the Code which pertains to this matter states: All members have a duty to treat members of the public, one another and staff appropriately and without abuse, bullying or intimidation, and to ensure that their work environment is free from discrimination and harassment;

    Whereas, in a report dated November 13th, 2018, the Integrity Commissioner has found that Councillor Karen Cilevitz breached the Council Code of Conduct (“Code of Conduct) by bullying and intimidating a resident with stage 4 Cancer;

    Whereas the Municipal Act permits Council, following a finding that a Member of Council has breached the Code of Conduct, to impose one of either a reprimand, or the suspension of a Member of Council’s remuneration of up to 90 days;

    Whereas a key component of this complaint was so outrageous that it received extensive media coverage from several media entities including 640AM, CFRB TALK 1010, CBC news as well as by rebel media, all of which portrayed Richmond Hill in a negative light;

    Therefore, be it resolved:

    1. That, commencing December 18th, 2018, Council direct staff to suspend Councillor Karen Cilevitz’s remuneration for a period of ninety (90) days for breaching the Code of Conduct.

    2. That Council directs that a grant be provided to Steffi Goodfield, in an amount equal to the remuneration suspended, to promote music in the Town of Richmond Hill.

    Whereas 778 Banshee Squadron, Royal Canadian Air Cadets, established in Richmond Hill, Ontario in 1969,

    Whereas young Canadians aged 12 to 18 participate in a variety of fun, challenging and rewarding activities whose purpose is to develop in youth the attributes of leadership, engaged and active citizenship and physical fitness, all within an environment that stimulates an interest in the Canadian Armed Forces;

    Whereas One in five private pilots in Canada is an ex-air cadet and 67% of commercial and airline pilots began as air cadets;

    Therefore be it resolved that the street name "Banshee" be approved to be added to the Town's Council Approved Street Name List.
