PUBLIC NOTICE

Due to efforts to contain the spread of COVID-19 and to protect all individuals, City facilities will not be open to the public to attend Council and Committee meetings until further notice.

Written Comments: The public may submit written correspondence regarding agenda matters by email to [email protected]. Written correspondence must be submitted by 12 p.m. the day before the meeting. Comments submitted will be provided to all Members of Council, considered as public information and noted in the public record.

Electronic Delegations: The public may apply to appear as an electronic delegation by video conference or by telephone. Applications to appear as an electronic delegation must be submitted by 12 p.m. the day before the meeting by email to [email protected] or by using the on-line application form found on Richmondhill.ca.  The Office of the Clerk will provide instructions on appearing as an electronic delegation.


  • a) That the assumption of the aboveground and belowground municipal services within Plan 65M-4049, Subdivision File 19T-03003 be approved;

    b) That the assumption of the external aboveground and belowground municipal services within the existing Myers Boulevard road allowance, associated with Subdivision File 19T-03003, be approved;

    c) That the assumption of the external storm and sanitary services within Part Lot 42, Plan 1960, described as Parts 2 and 3 on Plan 65R-28435, associated with Subdivision File 19T-03003, be approved;

    d) That Petrolia Court within the limits of Plan 65M-4049 (Subdivision File 19T-03003), be assumed as public highway;

    e) That Blocks 7 and 9 within Plan 65M-4049 be established as public highway to become part of Petrolia Court;

    f) That Block 19 within Plan 65M-2856 be establish as public highway to become part of Meyers Boulevard.

  • a) That the assumption of the aboveground and belowground municipal services installed within Part of Lots 157 and 158, Registered Plan 202, designated as Parts 3 and 4 of 65R-37373, be approved.

City Files D02-14038 and D03-14016 (Related Files D01-14007, D05-14009, D05-14011 and D06-14105)

  • a) That the revised Zoning By-law Amendment and draft Plan of Subdivision applications submitted by 9089802 Canada Corp. for lands known as Part of Lots F and G, Plan 1916 (Municipal Addresses: 0, 40 and 60 Harris Avenue), City Files D02-14038 and D03-14016, be approved, subject to the following:

    i) that the subject lands be rezoned from Urban (UR) Zone under By-law 128-04, as amended, to Multiple Residential One (RM1) Zone under By-law 235-97, as amended, with site specific provisions as set out in Staff Report SRPRS.20.054;

    ii) that the draft amending Zoning By-law as set out in Appendix “B” Staff Report SRPRS.20.054 be finalized to the satisfaction of the Commissioner of Planning and Regulatory Services;

    iii) that pursuant to Section 34(17) of the Planning Act, Council deem that no further notice be required with respect to any necessary modifications to the draft amending Zoning By-law to implement the proposed development on the subject lands;

    v) that the following take place prior to forwarding the final amending Zoning By-law to Council for consideration and enactment:

    1) that the applicant pay the applicable processing fee in accordance with the City’s Tariff of Fees By-law;

    2) that the applicant’s Site Plan application (City File D06-14105) be substantially completed to the satisfaction of the Commissioner of Planning and Regulatory Services;

    3) that the applicant register restrictions over the subject lands under Section 118 of the Land Titles Act;

    v) that the Plan of Subdivision as depicted on Map 6 to Staff Report SRPRS.20.054 be draft approved, subject to the conditions of draft approval as set out in Appendix “C” to Staff Report SRPRS.20.054;

    vi) that prior to draft approval being granted, the applicant pay the applicable processing fee in accordance with the City’s Tariff of Fees By-law;

    b) That the authority to assign 146.51 persons equivalent of servicing allocation to the proposed development to be constructed on the subject lands be delegated to the Commissioner of Planning and Regulatory Services subject to the City’s Interim Growth Management Strategy, and that the assigned servicing allocation be released in accordance with By-law 109-11, as amended.

  • a) That staff report SRCM.20.02 regarding the Richmond Hill Public Library Board vacancy, be received;

    b) That the City Clerk be directed to seek applications to fill the current vacancy on the Richmond Hill Public Library Board with a citizen member, notwithstanding that the vacancy would normally be filled on the recommendation of the York Region District School Board;

    c) That staff report back on recommendations to update the City’s composition requirements for the Richmond Hill Public Library Board that are consistent with the Public Libraries Act, R.S.O. 1990, c.P.44, as amended.

  • a) That the Terms of Reference for the Recover Richmond Hill Task Force, attached as Appendix A to staff report SRCM.20.07, be approved;

    b) That Councillor West, Councillor Chan and Councillor Muench be appointed to the Recover Richmond Hill Task Force.

  • a) That the update and initiatives outlined in staff report SRCFS.20.009, be received;

    b) That Council approve the charging of interest pursuant to sections 26.1 and 26.2 of the Development Charges Act, 1997, as amended;

    i) Effective as at January 1, 2020

    ii) At a rate of 5% compounded annually

    c) That Council approve the policy in Attachment A to staff report SRCFS.20.009, to administer the charging of interest in recommendation b;

    d) That Council authorize the Treasurer to give notice for a public meeting if required under the Development Charges Act, 1997, as amended.

  • That the following correspondence with respect to the Member Motion submitted by Councillor West regarding to reschedule an LPAT hearing on the Yonge/Bernard KDA to permit live and in person public participation, be received:

  • Whereas, AMO has recently announced that under Bill 189, Coronavirus Support and Protection Act, 2020, the provincial government has made strides to help municipalities to ensure proper consideration and public participation in planning matters during COVID-19. To quote AMO “We understand that Bill 189 temporarily suspends specified timelines for applications for development and land use planning matters. This relief may be applied retroactively to the date that an emergency was declared. This legislation allows those municipalities who want to proceed with planning applications to do so while allowing those that are not in a position to proceed to redirect efforts to dealing with the COVID-19 emergency without fearing appeals for missing deadlines.  The timelines would return to normal once the emergency ends.”

    Whereas, an LPAT hearing on the Yonge Bernard KDA has been adjourned due to COVID-19 and not yet rescheduled;

    Whereas, the uncertainty caused by not having a new scheduled hearing date means that in order to prepare for a hearing that may or may not happen in late June or early July, Richmond Hill Planning staff would need to ask Council to consider any revisions to this KDA plan by May 13th, during a time where live and in person delegations by the public are not presently allowed during Richmond Hill Council meetings;

    Whereas, this prohibition on public live and in person delegations means that citizens who have been asked to participate throughout this KDA process up to this point will not be able to effectively make their views known to Council in any way except by written submission, or even if able to make electronic submissions not all interested residents may have the confidence or available equipment to use the technology required;

    Whereas, considering such a major planning decision when the public cannot attend Council meetings in person is unfair to our residents, and is being precipitated by the confluence of in place COVID-19 restrictions and the timing of the LPAT hearing during these restrictions and is further exacerbated by the lack of clarity by LPAT on the rescheduling of a new date;

    Whereas, the situation could be easily solved if LPAT announced a new date for the Yonge Bernard KDA hearing far enough in the future to increase the possibility that restrictions requiring remote Council meetings because of COVID-19 will have ended, thus again allowing live and in person delegations from the public;

    Whereas, the answer regarding a new hearing date from LPAT must come before May 13th because this is the date that Council is currently scheduled to consider any changes to the KDA Plan;

    Now Therefore Be It Resolved: that Council endorse that a request be directed to LPAT to reschedule the Yonge Bernard KDA hearing to no earlier than October 31st, 2020, and that Planning Staff be directed to immediately make this request to LPAT so that the May 13th Council meeting dealing with the Yonge Bernard KDA matter can also be delayed in order to facilitate proper live and in person delegation from citizens when COVID-19 restrictions may be eased.
