PUBLIC NOTICE

 

City facilities are open to the public to attend Council and Committee meetings. The public can observe meetings of Council and Committees by attending in-person or by viewing the livestream of the open session part of these meetings which can be accessed on the City’s website (Richmondhill.ca) or on the City’s YouTube page (linked from the City’s homepage).

 

Public Comments: The public may submit written correspondence regarding agenda items by email to [email protected]. Written correspondence must be submitted by 12 p.m. (noon) one business day before the meeting. Comments submitted will be provided to all Members of Council, are considered as public information and will be included on the public agenda posted to the City’s website.

 

Delegations: Any person who wishes to speak to Council on agenda items must pre-register with the Office of the Clerk by 12 p.m. (noon) one business day before the meeting. Applications to appear as a delegation can be submitted by email to [email protected] or by using the on-line application form found on Richmondhill.ca. Delegations can be in person, or electronically by video conference or telephone. The Office of the Clerk will provide instructions on appearing as a delegation. 

 

Public Forum: Any person who wishes to speak to Council on a matter not on the agenda must pre-register with the Office of the Clerk by 12 p.m. (noon) one business day before the meeting. Persons wanting to address Council during the Public Forum portion of the meeting must register by sending an email to [email protected] or by using the on-line form found on Richmondhill.ca. Public Forum participation can be in-person, or electronically by video conference or telephone. A maximum of five persons will be allowed to register for the Public Forum on a first come first serve basis.

Minutes - Budget Committee of the Whole meeting BCW#01-23 held January 24, 2023

• That the minutes of Budget Committee of the Whole meeting BCW#01-23 held January 24, 2023 be adopted as circulated and the following recommendations be approved:

13.1.1

SRCFS.23.002 - 2023 Draft Capital Budget and 9 Year Forecast - (BCW Item 4.1) - (Proposed By-law 9-23)

• a) That the 2023 Draft Capital Budget in the amount of $74,393,300 including project management and overhead costs as identified in Appendix “A” of staff report SRCFS.23.002 be approved;

  b) That the Capital Forecast in the amount of $1,256,286,500 including project management and overhead costs as attached in Appendix “A” of staff report SRCFS.23.002 be received for information;

  c) That the 2023 Draft Capital Budget recommended funding sources identified in Appendix “B” of staff report SRCFS.23.002 be approved;

  d) That Projects Contingent on Grant Funding List in Appendix “C” of staff report SRCFS.23.002 be approved and funding allocated if grant funding becomes available;

  e) That the following projects be endorsed in principle in their entirety of $12,039,000 and approved to move to tender phase, with multi-year financing as follows:

  g) That staff be directed to investigate the feasibility of advancing the Cedar Avenue Watermain Replacement Project with design commencing in 2023 and construction in 2024, funded from the appropriate reserve account, and report back at the February 8, 2023 meeting of Council.

13.1.2

SRCFS.23.001 - Capital Project Financial Status Report - (BCW Item 4.2)

• a) That all capital projects listed in Appendix “A” to staff report SRCFS.23.001;

  i) Be closed;

  ii) The net surplus of $16.44 million be returned to the original funding source(s) as at December 31, 2022 as identified; and

  b) That Budget and Funding Adjustments net surplus of $0.83 million as at December 31, 2022 as noted in Appendix “B” to staff report SRCFS.23.001, be approved; and

  c) That the Status of Ongoing Capital Projects List in Appendix “E” to staff report SRCFS.23.001, be received.

13.2

SRPI.23.001 - Request for Direction - Official Plan Amendment and Zoning By-law Amendment Applications - Leslie Elgin Developments Inc. - 0 John Birchall Road - City Files D01-21008 and D02-21016

• a) That the Ontario Land Tribunal be advised that Council does not support the Official Plan Amendment and Zoning By-law Amendment applications submitted by Leslie Elgin Developments Inc. for lands known as Block 51, Plan 65M-4668 (Municipal Address: 0 John Birchall Road), City Files D01-21008 and D02-21016, for the primary reasons outlined in Staff Report SRPI.23.001;

  b) That appropriate City staff and/or external consultants be directed to appear at the Ontario Land Tribunal in support of Council’s position concerning the subject applications and appeals;

  c) That City staff and the applicant continue discussions towards a potential resolution of the outstanding appeals and the submission of a revised development proposal that is supportable and represents good planning on the subject lands.

13.3

SRPI.23.006 - Request for Approval - Private Street Naming Application - Zonix Kent Inc. - 356 King Road - City File AA-22-0042

• a) That Staff Report SRPI.23.006 regarding a Private Street Naming Application submitted by Zonix Kent Inc. for the lands known Part Lot 37, Plan 202 (Municipal Address: 356 King Road) be approved subject to the following:

  1. that the proposed private street name Davide Nicola Lane (P) be approved in accordance with Staff Report SRPI.23.006; and
  2. that staff be directed to  bring forward a by-law to implement the approval of the private street name in accordance with SRPI.23.006.

13.4

SRPI.23.007 - Request for Approval - Private Street Naming Application - 8608415 Canada Inc. - 25, 45 and 61 Harris Avenue - City File AA-22-0048

• a) That Staff Report SRPI.23.007 regarding a Private Street Naming Application submitted by 8608415 Canada Inc. for the lands known Block N, Plan 1916 (Municipal Address: 25, 45, and 61 Harris Avenue be approved subject to the following:

  1. that the proposed private street name Russell Fleming Lane (P) be approved in accordance with Staff Report SRPI.23.007; and
  2. that staff be directed to bring forward a by-law to implement the approval of the private street name in accordance with SRPI.23.007.

13.5

SRPI.23.010 - Request for Approval - Zoning By-law Amendment - Eugene and Marie Sturino and Domenic and Daniela Marie Sorbara - 83 and 85 Elm Grove Avenue - City File D02-22018

• a) That the Zoning By-law Amendment application submitted by Eugene and Marie Sturino and Domenic and Daniela Marie Sorbara for the lands known as Lots 5 and 6, Plan M-1563 (Municipal Addresses: 83 and 85 Elm Grove Avenue), City File D02-22018 be approved, subject to the following:

  1. that the subject lands be rezoned from Residential Urban (RU) Zone under By-law 1275, as amended, to Single Detached Five (R5) Zone under By-law 313-96, as amended, and that the amending Zoning By-law establish site specific development standards as outlined in Staff Report SRPI.23.010;
  2. that the amending Zoning By-law be brought forward to a future Council Meeting for consideration and enactment.

13.6

SRPI.23.016 - Traffic Regulation Changes (Speed Limit, Parking, Traffic Control and Turning Restrictions) - (Proposed By-laws 16-23, 17-23, 18-23, 19-23, 20-23 and 21-23)

• a) That the speed limit, parking and traffic control regulation changes outlined in Staff Report SRPI.23.016, entitled Traffic Regulation Changes (Speed Limit, Parking and Traffic Control and Turning Restrictions) be approved;

  b) That By-law 16-23, attached as Appendix 8 to Staff Report SRPI.23.016, be enacted to amend Municipal Code Chapter 1126 in order to reduce the speed limit on a number of City of Richmond Hill roads to 40 km/h;

  c) That York Regional Police be advised of the new reduced posted speed limits and be requested to provide enforcement along the roads as resources permit;

  d) That By-law 17-23, attached as Appendix 9 to Staff Report SRPI.23.016, be enacted to amend Municipal Code Chapter 1116, being By-law 402-89, in order to implement the changes to parking regulations outlined in Staff Report SRPI.23.016;

  e) That By-law 18-23, attached as Appendix 10 to Staff Report SRPI.23.016, be enacted to amend Municipal Code Chapter 1128, being By-law 35-97, in order to implement the changes to intersection traffic control outlined in Staff Report SRPI.23.016;

  f) That By-law 19-23, attached as Appendix 11 to Staff Report SRPI.23.016, be enacted to amend Municipal Code Chapter 1133 in order to implement the changes to turn movement prohibitions outlined in Staff Report SRPI.23.016;

  g) That By-law 20-23, attached as Appendix 12 to Staff Report SRPI.23.016, be enacted to amend Municipal Code Chapter 1135 in order to implement the changes to U-turn prohibitions outlined in Staff Report SRPI.23.016;

  h) That By-law 21-23, attached as Appendix 13 to Staff Report SRPI.23.016, be enacted to amend By-law 69-16 in order to establish a monetary penalty for the offence of parking on a highway within 30 metres (100 feet) of a pedestrian crossover.

SRPI.23.026 - Response to Budget Committee of the Whole request to advance the Watermain Replacement on Cedar Avenue

• a) That staff report SRPI.23.026 regarding Response to Budget Committee of the Whole request to advance the Watermain Replacement on Cedar Avenue be received for information;

  b) That funding in the amount of $150,000.00 be made available from the Watermain Repair and Replacement Reserve Fund for 2023 to advance the design for the replacement of the Cedar Avenue Watermain;

  c) That construction funding be added to the 2024 Capital Budget and Forecast as a 2024 construction project.

Member Motion - Mayor West - Stopping Harassment and Abuse by Local Leaders Act, 2022

• WHEREAS Bill 5 - Stopping Harassment and Abuse by Local Leaders Act, 2022 was introduced in the Ontario Legislature by MPP Stephen Blais through a Private Member’s Bill on August 10, 2022.

  WHEREAS the City of Richmond Hill and Council are committed to demonstrating good governance and greater accountability to its Code of Conduct and workplace policies.

  NOW THEREFORE BE IT RESOLVED:

  1. That Richmond Hill Council endorses Bill 5 - Stopping Harassment and Abuse by Local Leaders Act, 2022 which would require the Code of Conduct for municipal Councillors and members of local boards to include a requirement to comply with workplace violence and harassment policies and permit municipalities and local boards to direct the Integrity Commissioner to apply to the court to vacate a member’s seat if the Commissioner’s inquiry determines that the member has contravened this requirement.
  2. That Richmond Hill Council expresses its support for Bill 5 by directing the City Clerk to send this motion to Premier of Ontario; the Ontario Minister of Municipal Affairs and Housing; the Orléans MPP Stephen Blais;  the Association of Municipalities of Ontario (AMO); the Local Members of Parliament (MP’s); the Local Members of Provincial Parliament (MPP’s); Ontario Big Cities Mayors Caucus (OBCM); the Large Urban Mayors’ Caucus of Ontario; the Small Urban GTHA Mayors, as well as York Region and its member municipalities.
